Effective date: April 4, 2025
These Terms and Conditions ("Terms") govern your access to and use of the ResourcePulse service ("Service"), operated by Denis Połyncew Software Engineering, NIP: 7543173139, REGON: 544330578, Address: ŚW. MIKOŁAJA 8/11/208, 50-125 Wrocław, Poland ("we", "us", or "our"). By signing up for or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
ResourcePulse is a GitHub Action and cloud-based analysis service that reviews Azure Bicep infrastructure-as-code changes on pull requests — providing cost delta estimates, governance policy findings, and AI-generated suggestions without requiring Azure subscription access.
ResourcePulse offers the following plans:
Paid plans (Starter and Team) include a 14-day free trial. Your credit card is collected at sign-up but will not be charged until the trial period ends. You may cancel at any time during the trial without being charged.
After the trial, subscriptions are billed monthly in advance. All prices are in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days' advance notice delivered by email or in-app notification.
Payments are processed by Paddle (paddle.com), our Merchant of Record. Paddle handles billing, invoicing, and applicable tax collection on our behalf.
All payments are processed by Paddle, which acts as Merchant of Record for ResourcePulse transactions. Paddle's Buyer Terms and applicable consumer protection laws apply to all purchases.
We offer a 14-day free trial on paid plans. If you cancel before the trial ends, you will not be charged.
After the trial period, subscription fees are generally non-refundable except where required by applicable law or where a refund is granted under Paddle's policies or our exception policy below. If you cancel during a billing period, you will retain access until the end of that paid period, and the subscription will not renew.
Nothing in this policy limits any mandatory consumer rights, including any applicable rights of withdrawal or statutory remedies relating to digital services that are not in conformity with the contract.
Where ResourcePulse experiences a technical failure or other service issue, refund or credit requests may be considered in accordance with applicable law and the circumstances of the case. Requests may be sent to hello@resourcepulseapp.com within 14 days of the charge.
Paddle may also issue refunds in accordance with applicable law and Paddle's own policies.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
The Service, including its software, design, and documentation, is owned by Denis Połyncew Software Engineering and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
You retain full ownership of the Bicep files and infrastructure definitions you submit for analysis. We do not claim any rights over your content. See our Privacy Policy for details on what data is transmitted and how it is handled.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No SLA or uptime guarantee. ResourcePulse does not guarantee any specific level of availability, uptime, or response time. The Service may be interrupted for maintenance, updates, or reasons outside our control. We are not liable for any losses resulting from Service unavailability.
Cost estimates are not financial advice. Cost estimates produced by ResourcePulse are approximations based on publicly available Azure pricing data at the time of analysis. They do not constitute financial, procurement, or professional advice. Actual Azure costs may differ materially due to usage patterns, reserved instances, discounts, or pricing changes. You should independently verify all cost estimates before making provisioning or budgeting decisions. ResourcePulse accepts no liability for infrastructure spend incurred in reliance on its estimates.
Policy findings and AI suggestions are informational only. ResourcePulse does not guarantee that following its suggestions will result in a compliant, secure, or cost-optimal deployment. Outputs should be reviewed by a qualified engineer before being acted upon.
To the maximum extent permitted by applicable law, and without limiting any non-excludable consumer rights, ResourcePulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.
You may cancel your subscription at any time through your account settings or the subscription management method made available by Paddle. Cancellation takes effect at the end of the current billing period; access continues until then.
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to access the Service ceases and your API key(s) will be revoked.
If you are a consumer resident in the European Union, European Economic Area, Switzerland, or the United Kingdom, you may have a statutory right to withdraw from certain distance contracts for digital services within 14 days of conclusion of the contract.
Where applicable, and where you expressly request immediate access to the Service before the end of that withdrawal period, you acknowledge that the Service may begin immediately. Any statutory withdrawal rights you have will be governed by applicable law and, where relevant, Paddle's Buyer Terms and refund policy.
Nothing in these Terms limits any statutory rights you have under applicable consumer protection law that cannot be excluded or limited by contract.
These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law provisions.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Wrocław, Poland, except where mandatory consumer protection law in your country of residence provides otherwise.
If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
